Hongkong, 16th. March,1908.
I have the honour to acknowledge your letter of March 12th. on the subject of the Registry Depart- -ment. Your Honour concurs that the Registrar is rightly accord- -ed the status of Head of Department. That status involves the condition that any departmental changes are communicated direct to the Head through the Colonial Secretary, and the Head of Department expresses his views in the same way. In the case of the Supreme Court Registry the Head of Department would natural- -ly keep the Chief Justice fully informed. This is the inter-
-pretation which I place upon Sir George Phillippo's minute, and so far as I am aware this has been the practice of the Colony for many years. I shall, however, be glad to give directions that Your Honour shall be informed of all proposed changes in the Registrar's Department either by the Colonial Secretary or by the Head of Department.

In reply to paragraph 5 of Your Honour's letter. Though my residence in this Colony has extended over only a few months, I have had occasion to refer to numerous records and to trace the history of more than one large question which has agitated the Cormunity. I have been led to a conclusion in regard to the Judges, the exact opposite of that held by Your Honour. I have noted that the Governor has fre- -quently indeed constantly referred to the Chief Justice for his advice and opinion on such matters. But it is only possible for a Governor to do so if the Chief Justice is wholly removed from the polemics of Administrative controversy. I submit with all courtesy that the word "ignored" in reference to the at- -titude of the Government towards the Judges in this Colony a word used more than once in this paragraph and other letters
